Confidentiality and data secrecy agreement for employees (Austria)
A confidentiality agreement for employees in Austria, in German, with the undertaking to keep data secrecy that every employer must obtain from its staff under § 6 of the Austrian Data Protection Act (DSG), including the information on transfer instructions and the consequences of a breach. It protects trade secrets under §§ 26a ff of the Unfair Competition Act (UWG) by naming categories and secrecy measures, leaves out the employee's own pay and whistleblowing reports, and offers an optional non-compete clause under § 2c AVRAG and § 36 AngG.
Resignation letter (Austria)
A resignation letter for an employee in Austria (Selbstkündigung): notice ending your employment with the notice period, or during the probation month, on the date you choose or else on the next possible date, asking for confirmation, a written reference (Dienstzeugnis), the final pay and pay in lieu of untaken leave. Austrian law prescribes no form, but many collective agreements (Kollektivverträge) require writing: print, sign and hand it over against a receipt. Final deadline for withheld pay before leaving early (Austria)
A letter by which an employee in Austria gives the employer a concrete final deadline (Nachfrist) for pay withheld, announcing that the employee will leave early if it is not paid (§ 26 Z 2 AngG; for blue-collar workers § 82a lit d GewO 1859). Leaving over unpaid wages without such a deadline has been held unjustified, so this letter is the first step. It also meets the forfeiture deadlines of the collective agreement. Special or limited power of attorney for one transaction (Austria)
A power of attorney for one transaction or one kind of business in Austria: a visit to an authority, collecting a document, registering a car, handing over a flat, a single sale. Under § 1008 of the Austrian Civil Code (ABGB) it must name the business precisely — for a gift or accepting an inheritance, the single transaction. Before authorities it proves the agent’s authority in writing (§ 10 AVG, § 83 BAO). With an expiry date, restrictions and room for certification if it is used in the land register. Authority for a child's care and medical treatment (Austria)
The authority by which parents leave the care and upbringing of their child to grandparents, relatives, a host family or a holiday camp for a set period, and allow consent to medical treatment — routine care, emergencies or a described treatment. It follows Austria's age rule: from 14 a child is presumed able to decide alone (§ 173 ABGB, the Austrian Civil Code), so for older children the authority only supplies the extra consent serious treatment needs. Training cost repayment agreement (Austria)
An agreement on repaying training costs under § 2d of the Austrian Employment Contract Law Adaptation Act (AVRAG), in German: in writing, before the training begins and with the exact amount, as the law and the courts require, for training that gives specialist skills usable with other employers too. With a bond of at most four years (eight in special cases), a monthly pro-rata reduction, the cases in which the law excludes repayment (probation, the employer's notice, justified resignation, end of a fixed term) and the rule of § 11b AVRAG that the employer pays for training the job requires.
Letter claiming unpaid wages, overtime and special payments (Austria)
A letter by which an employee in Austria claims unpaid amounts from the employment in writing: wage or salary, overtime with its premium, special payments (13th and 14th salary) and other claims, with a total, a deadline and a bank account. It meets the forfeiture deadlines of the collective agreement (Verfallsfristen), which are often far shorter than the three-year limitation period (§ 1486 Z 5 ABGB), and refers to interest under § 49a ASGG. Notice of parental part-time work, Elternteilzeit (Austria)
The written notice of parental part-time work (Elternteilzeit) to an Austrian employer under § 15j of the Maternity Protection Act (MSchG) or § 8b of the Fathers' Leave Act (VKG): start, length, hours and their pattern, the child, and since when you have been employed. You choose whether you claim the statutory right (more than 20 employees, three years' employment) or ask for an agreement. The notice must be in writing, so signed — a plain e-mail is not enough — and must arrive at least three months before the start. In German.
Agreement ending employment by mutual consent (Austria)
A termination by mutual consent of an employment in Austria (einvernehmliche Auflösung), as an agreement between employer and employee: end date, final pay and garden leave, leave and pay in lieu, statutory and voluntary severance (Abfertigung), the written reference and the return of work equipment. It asks about protection under Austria's Maternity Protection Act (MSchG) and Fathers' Parental Leave Act (VKG), which requires writing (§ 10 Abs 7 MSchG), and about the works council (§ 104a ArbVG). The AMS imposes no waiting period afterwards. Not for apprenticeships. In German.
Request for an employment reference (Austria)
A letter asking the employer in Austria for a written reference (Dienstzeugnis) under § 1163 ABGB and § 39 AngG — a final reference when the employment ends, or an interim one during it, which is issued at the employee's cost. Austrian law owes only the simple reference stating the length and kind of the work, and it may contain nothing that makes finding a new job harder; the letter also asks politely for a favourable description of duties and achievements. Notice of parental leave (Karenz) to the employer (Austria)
The notice telling an Austrian employer when your parental leave (Karenz) starts and how long it lasts, under the Maternity Protection Act (§ 15 MSchG) or the Fathers' Leave Act (§ 2 VKG): child and date of birth, leave from–to, the other parent's parts. For children born from 1 November 2023, Karenz runs to the end of the 22nd month, or the 24th if shared — the document prints the rule for your child. With a receipt block. Childcare benefit (Kinderbetreuungsgeld) is claimed separately from the health insurer, usually the ÖGK. In German.
Agreement on training leave or reduced hours for training (Austria)
The agreement between employer and employee on Weiterbildungszeit or Weiterbildungsteilzeit — the AMS's names for full release and reduced hours for training, by statute the educational leave (Bildungskarenz, § 11 of the Austrian Employment Contract Law Adaptation Act, AVRAG) and educational part-time (Bildungsteilzeit, § 11a AVRAG) as reformed for 2026: start and end, hours, current education level, the training and its aim. It takes effect only if the AMS grants the training allowance (Weiterbildungsbeihilfe), to which there is no right. The allowance itself is claimed from the AMS, online or at the regional office. Travel consent for a minor travelling abroad (Austria)
A travel consent for a child leaving Austria without their parents, with one parent, with grandparents, on a school or club trip, or alone — in German and English. Austrian law does not require one, but border officers and airlines often ask for it, and some countries want the signatures certified. It sets out the child, the parents holding custody (Obsorge) and how to reach them, the journey and the accompanying adult. The Austrian motoring club ÖAMTC also offers free models. Fill in, print and sign — before a notary or at a district court (Bezirksgericht) if certification is needed.
Telework agreement (Austria)
The written telework agreement required in Austria since 1 January 2025 by § 2h of the Employment Contract Law Adaptation Act (AVRAG), in German — Austria's home-office agreement under the new law: places and extent of telework, working time and availability, who provides the digital equipment and what cost allowance is paid, data protection, accident insurance under § 175 ASVG, and ending it for an important reason on one month's notice to the end of a month. It supplements an existing contract of employment.
Request to inspect receipts, and objections to a service-charge statement (Austria)
The letter to an Austrian landlord or property manager when the annual statement of Betriebskosten (service charges) raises questions: it asks to inspect the invoices, contracts and the split between flats, lists the items you dispute now, asks for a corrected statement and pays any disputed balance only under reservation. Where the Austrian Tenancy Act (MRG) applies in full, the statement is due by 30 June and the receipts must be open to inspection (§ 21 Abs 3 MRG). In German.
Tenant's application to the conciliation board or district court under § 37 MRG (Austria)
The tenant's application in Austria's non-contentious tenancy procedure: to have the main rent checked, the deposit repaid, the service-charge statement reviewed or repairs carried out (§ 37 Abs 1 of the Austrian Tenancy Act, MRG) — with the parties, the flat, the request, the grounds and the enclosures. Where the municipality has a conciliation board (Schlichtungsstelle), it is approached first (§ 39 MRG); elsewhere the district court for the flat. Vienna prescribes no form; if your municipality offers its own, you may use it free of charge instead. Signed by all tenants. In German.
Claim for compensation for a tenant's improvements under § 10 MRG (Austria)
The letter a tenant in Austria sends on leaving a rented flat to claim compensation for improvements — a new bathroom, heating, electricity, gas or water pipes — that remain effective and useful beyond the tenancy (§ 10 of the Austrian Tenancy Act, MRG). The claim must be made in writing with the invoices, within 14 days of the tenant's own notice reaching the landlord, or it is lost. The letter lists the work, the costs and the amount claimed after depreciation. In German; print, sign and send by registered post.
Landlord's demand for an index-linked rent increase (Austria)
The landlord's written demand for a higher rent under the index clause of a lease in Austria: the clause, the index and its values, the percentage, the old and new main rent (Hauptmietzins) and the rent date from which it applies. Since 2026, rents under the Austrian Tenancy Act (MRG), in full or in part, may be adjusted only once a year on 1 April, within the limits of the Rent Indexation Act (MieWeG); under the full MRG the demand must reach the tenant at least 14 days before the rent date and never applies retroactively (§ 16 Abs 9 MRG). Landlord's notice ending a lease wholly exempt from the MRG (Austria)
The landlord's notice ending the lease of a flat where Austria's Tenancy Act (MRG) does not apply at all (full exemption, § 1 Abs 2 MRG), for instance in a house with no more than two separate flats: out of court and without reasons, on the agreed or else the statutory period (§ 560 ZPO), or else to the next possible date, with a receipt section. Important: where the MRG applies in full or in part, a landlord can give notice only through the court, on the form “Gerichtliche Aufkündigung” (ZPForm 102), which the Austrian justice system provides free on justizonline.gv.at — this letter is not for that case. Tenant's claim to recover increases under an invalid index clause (Austria)
The tenant's letter in Austria reclaiming rent increases charged under an invalid index clause in the lease: the clause, the grounds, the period, the amount, a deadline and the account; further increases are paid only under reservation. Note: the case law is still moving — the Supreme Court (OGH) held clauses invalid in 2023, took a different view in 2025 (10 Ob 15/25s) and ruled again in 2026 (6 Ob 34/26g); for leases signed before 2026 the rent indexation act (MieWeG) limits refunds to five years. Have the clause checked before sending, for instance by the tenants' association or the Chamber of Labour; the letter only asserts the claim. In German.
Handover record for a flat on moving out (Austria)
The record of handing a rented flat in Austria back at the end of the tenancy, filled in and signed together: the date of return, meter readings for the final bills, keys returned, the condition of each room, the damage the landlord points out beside the tenant's view of it, any agreements, the deposit and the account for its return. The date starts the clocks under the Austrian Civil Code: one year for the landlord's damage claims (§ 1111 ABGB), six months for the tenant's outlays (§ 1097 ABGB). In German.
Subletting a flat: request for the landlord's consent, or notice to the landlord (Austria)
The letter to the landlord when you sublet part of a rented flat in Austria: a request for consent where the lease requires it, or a notice where the lease does not forbid subletting. It names the rooms, the period, the subtenant, the sublet rent and the number of occupants, and relies on § 11 of the Austrian Tenancy Act (MRG) — where a ban binds only for an important reason — or on § 1098 of the Austrian Civil Code (ABGB). Landlord's reminder of rent arrears (Austria)
The landlord's formal reminder to a tenant in Austria who is behind with the rent: the amounts owed for each month, the total, a deadline and the account. Under the Austrian Tenancy Act (MRG) a court notice to quit for arrears (§ 30 Abs 2 Z 1 MRG), like ending the lease under § 1118 of the Austrian Civil Code (ABGB), requires a reminder after the rent fell due that states the arrears specifically. You choose which step follows if the tenant does not pay. The court notice itself is not a letter but is filed at the district court — this is the reminder that must come first. In German.
Sublease of a room in a shared flat (Austria)
The agreement by which the main tenant of a flat in Austria sublets a room in the shared flat: the room and shared use of kitchen and bathroom, rent with a flat-rate charge for costs, the deposit under § 16b of the Austrian Tenancy Act (MRG), house rules and notice. It asks how far the MRG applies, because the subtenant's protection turns on it: under full or partial application the main tenant too can end the sublease only through the court, with the ground of § 30 Abs 2 Z 12 MRG, and under full application the sublet rent is capped (§ 26 MRG).
